1. ACCEPTANCE OF TERMS
1.1 Service - Owned and operated by Intelligent Tracing Ltd - Company Number 07341742 - VAT Number 116 4795 03 Access to our service is permitted on a temporary basis and we reserve the right to withdraw or amend our service we provide without notice. We will not be liable if for any reason our service is unavailable at any time or for any period. The data is provided without any guarantees, conditions or warranties as to its accuracy, comprehensiveness, completeness, quality, currency, error-free nature, compatibility, security or fitness for purpose. This website and service is a trading platform of Intelligent Tracing Ltd. Our place of business is Intelligent Tracing Ltd, Unit 30 Hallbridge Gardens, Bolton, BL1 8UT.
1.2 We have a legal obligation to confirm all clients’ details for both anti money laundering (AML) and on occasions clients have accessed information for unlawful reasons, in these rare occasions we need to show a clear audit trail to the police.
1.3 All clients (you) personal details provided at subscription will be checked by our ID verification team, this process may involve a credit check against the client, and ALL clients provide clear consent to perform a credit check at your supplied address to confirm all supplied personal details. If you do not consent to a credit check please do not subscribe to our service. It is important that we collect only accurate data about you.
1.4 You agree that you shall not use the website or service for illegal purposes, and will respect all applicable laws and regulations. You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement including ALL debt recovery costs if any payment is reversed or disputed.
1.5 Our duties are owed only to the individual/company whose instructions we are acting upon and we disclaim any liability to any other person. Unless specifically agreed in writing by us in advance, you agree that you will not be acting for another person/company.
1.6 The terms on which we are acting on your matters (contained herein or otherwise) are intended to be enforceable solely by the instructing party and us.
1.7 We do not accept any liability for services or information provided by any third parties instructed by us on your behalf in respect of your matters.
1.8 Data Protection
For the avoidance of doubt the debtor tracing instructions are accepted on the basis that our services are conducted under the direction of the client and as such we are deemed the Data Processor and the client, and/or the principal is deemed Data Controller.
We may, during the course of enquiries, leave "footprints" of our searches on Credit Reference Agency databases, under the search purpose provided on the subject’s credit file and we will proceed based upon your confirmation by agreeing to our terms that you have obtained the subject’s consent, for example, in the original application or you can rely upon an exemption.
